Trading in the commodities markets involves substantial risk and YOU CAN LOSE A LOT OF MONEY, and thus is not appropriate for everyone. You should carefully consider your financial condition before trading in these markets, and only expendable risk capital should be used.
The Opening Trade algorithm is designed to trade on the futures trading market. These markets are perhaps the most volatile markets traded on any exchange in the world, and often experience large daily price movements. In addition, these markets are often illiquid, making it difficult to execute orders at desired prices. Also, during periods of extreme volatility, trading in these markets may be halted due to so-called "circuit breakers" put in place by the exchange to alleviate such volatility. In the event of a trading halt, it may be difficult or impossible to exit a losing position. Please be aware of this risk.
The Opening Trade algorithm is a day trading system, meaning most positions will & should be initiated and liquidated within the same trading day and session, but not guaranteed. Most positions will result in no positions at the end of the day. Please note that this strategy will necessarily result in more trading activity, and thus more commissions may be charged to you by your choice of broker. These increased costs will make it more difficult to achieve profits. Generally speaking, day trades will not subject a trader to “calls” for additional margin from the exchanges. However, market conditions may make it impossible to exit a position during the day session, and thus there is a possibility that a trader may be subject to margin calls. You will need to understand the specifics for your positions and accounts by working with and speaking to your broker representatives to know your specific account details. In addition, if a trader is unable to exit a position during the day session, the trader will be subject to international market risk associated with overnight trading. Also, if a trader is unable to exit a position during the day session, the trader may be forced to liquidate such position on electronic trading systems, which are less liquid than the day session which could be subject to very large “slippage” (exit orders being filled at less than desirable prices) for exit pricing. Please be aware of the risks of holding trades overnight, and please contact your broker for more information on how to avoid these risks.
The Opening Trade algorithm is a speculative trading algorithm designed to buy and sell future contracts. No claims as to past, present or future profitability of these or other The Opening Trade algorithms, and there is no guarantee that the algorithm will provide any profits to traders using the algorithm, and indeed may cause such traders to incur losses.
ANY TRADES EXECUTED; PLACED; OPENED, AND OR CLOSED BASED UPON RELIANCE ON The Opening Trade ALGORITHMS, AND OR ANY INFORMATION RELATED THEREOF, ARE DONE SO AT YOUR OWN RISK FOR YOUR OWN ACCOUNT. The Opening Trade DOES NOT AND WILL NOT EVER RECOMMEND ANYTHING INVOLVING AN ACTION OUTSIDE OF A SIMULATED ACCOUNT. PAST PERFORMANCE IS NO GUARANTEE OF FUTURE RESULTS. WHILE THERE IS GREAT POTENTIAL FOR REWARD TRADING FUTURES, THERE IS ALSO SUBSTANTIAL RISK OF LOSS IN ALL TRADING. YOU MUST DECIDE YOUR OWN SUITABILITY TO TRADE OR NOT. FUTURES RESULTS CAN NEVER BE GUARANTEED. THIS IS NOT AN OFFER TO BUY OR SELL FUTURES OR COMMODITY INTERESTS.

ELECTRONIC TRADING AND ORDER ROUTING SYSTEMS DISCLOSURE STATEMENT
Electronic trading and order routing systems differ from traditional open outcry pit trading and manual order routing methods. Transactions using an electronic system are subject to the rules and regulations of the exchange(s) offering the system and/or listing the contract. Before you engage in transactions using an electronic system, you should carefully review the rules and regulations of the exchange(s) offering the system and/or listing contracts you intend to trade.
DIFFERENCES AMONG ELECTRONIC TRADING SYSTEMS
Trading or routing orders through electronic systems varies widely among different electronic systems. You should consult the rules and regulations of the exchange offering the electronic system and/or listing the contract traded or order routed to understand, among other things, in the case of trading systems, the system’s order matching procedure, opening and closing procedures and prices, error trade policies, and trading limitations or requirements; and in the case of all systems, qualifications for access and grounds for termination and limitations on the types of orders that may be entered into the system. Each of these matters may present different risk factors with respect to trading on or using a particular system. Each system may also present risks related to the system access, varying response times, and security. In the case of internet-based systems, there may be additional types of risks related to system access, varying response times and security, as well as risks related to service providers and the receipt and monitoring of electronic mail.
RISKS ASSOCIATED WITH SYSTEM FAILURE
Trading through an electronic trading or order routing system exposes you to risks associated with system or component failure. In the event of system or component failure, it is possible that for a certain time period, you may not be able to enter new orders, execute existing orders, or modify or cancel orders that were previously entered. System or component failure may also result in loss of orders or order priority.
SIMULTANEOUS OPEN OUTCRY PIT AND ELECTRONIC TRADING
Some contracts offered on an electronic trading system may be traded electronically and through open outcry during the same trading hours. You should review the rules and regulations of the exchange offering the system and/or listing the contract to determine how orders that do not designate a particular process will be executed.
LIMITATION OF LIABILITY
Exchanges offering an electronic trading or order routing system and/or listing the contract may have adopted rules to limit their liability, the liability of FCMs, and software and communication system vendors and the amount of damages you may collect for system failure and delays. These limitations of liability provisions vary among the exchanges. You should consult the rules and regulations of the relevant exchange(s) in order to understand these liability limitations.
____________
* Each exchange’s relevant rules are available upon request from the industry professional with whom you have an account. Some exchange’s relevant rules also are available on the exchange’s internet home page.
Additional Notices
There are no guarantees or certainties in trading. Reliability of trading signals for mechanical systems is in probabilities only. Trading involves hard work, risk, discipline and the ability to follow rules and trade through many tough periods during system draw-downs. If you are looking for guarantees, trading is not for you. Most people lose money when trading. One of the reasons is that they lack discipline and are unable to be consistent. A system can help you become consistent. The ability to be disciplined and take the trades is equally as important as any technical indicator(s) a trader uses. Ironically, worrying about the money aspect of trades can contribute to and cause a trader to make trading errors. Therefore, it is important to only trade with true disposable risk capital if you are going to be trading live in any capacity.
